Study Privacy Notice

Thank you for your participation in the Modes of Change Leadership Assessment (the “Study”).
As part of the Study, Persuade Consulting L.L.C. (the “Researcher”) will collect certain personal information from and about you. This notice describes the types of personal information to be collected, how the information will be used, to whom the information will be disclosed, and your rights with respect to such information.
Note, when your personal information has been processed so that it no longer identifies you, or cannot be reasonably associated with you, then the information is “de-identified” or “anonymized,” and therefore no longer qualifies as “personal information.” The Researcher will ensure that such de-identified information is maintained as such.
The categories of personal information to be collected by the Researcher include: (1) your contact information, such as your name, email, phone number, and mailing address; (2) survey responses, which could include self-reported data and narrative content or reflections; (3) interview data, including in the form of audio and video recordings; (4) for certain programs, data generated by Study observers; and (5) to the extent you interact with an online form or platform, the details of the device and browser used to access the online form or platform. We will retain such information for a period of time that reflects the purposes for which the information was collected and our legal or contractual obligations.
Your personal information will be used by the Researcher to conduct the Study, improve its products, services, and business processes, perform independent analytics for business purposes, comply with laws, and for any other purposes disclosed at the time of collection. When the information is used to conduct the Study, further the internal research or business purposes of others, improve our products, services, or business processes, perform independent analytics for business purposes, or comply with laws, we are processing the information for our legitimate interests in administering the Study, administering our business, and exercising our legal rights – in other words, we are not relying on your consent as the legal basis for processing.
In connection with the foregoing, the Researcher may disclose your personal information to those of its personnel who assist with the Study or the administration of the Researcher’s business; the Researcher’s service providers or vendors that assist with the administration of the Study or the Researcher’s business; and partners, affiliates, or other third parties who may want to use the information for their own internal business or research purposes. Any transfers from any other country to the United States will be subject to an appropriate transfer mechanism (such as required contractual clauses), if required by law.
The Researcher may also disclose your personal information when necessary or reasonable to protect the safety, property, or other rights of the Researcher, other Study participants, or others. This may include disclosures and cooperation with law enforcement authorities. The Researcher may disclose or transfer your personal information in connection with a merger or sale involving the Researcher’s business, or as part of a corporate reorganization, dissolution, or restructuring, or other change in corporate control or similar transaction.
Depending on the laws of the jurisdiction in which you reside, you may have the right to request: (1) we confirm that we are processing your personal information and/or access such data; (2) we update or correct inaccuracies in your personal information; (3) we delete your personal information; (4) a copy of the personal information processed by us; (5) a list (or categories) of the third parties to whom we have disclosed your personal information; or (6) you be opted out of the sale of your personal information, the processing of your personal information for targeted advertising purposes, the use of your personal information or automated decision-making or automated profiling. You may also have the right to object to or restrict certain processing activities.
Notwithstanding such rights, an exception or exemption may permit us to deny such request, or we may not engage in the relevant activity and therefore there would be no related request to fulfill. You may exercise any of your rights, however, by contacting us at kj@krisjennings.com with the subject line, “Data Subject Request.” We may ask you to provide additional details to enable us to verify your identity and your request. We will respond to your request within the timeframe required by law. In the event we decline your request, depending on the applicable law, you may have the right to appeal the decision by contacting us at the same email address. You may also be entitled to lodge a complaint with the appropriate regulatory authority in your jurisdiction.
